| On 17 Nov. 2004, the International Labor Organization (ILO)
concluded the Committee’s Recommendations regarding the joint
complaint of JRU and ITF against a violation of trade union rights
by the Japanese Government in the JR URAWA case, Tokyo station case
and Trespass case (Case No.2304). The Committee makes the following
recommendations:
(1) Request the Government to keep the Committee informed of the progress of the judicial proceedings and to communicate the final judgment once rendered. (2) Request the Government to immediately return any remaining confiscated items which do not have a direct connection to the case to the complainant. (3) The police should abstain from any declaration which might damage the reputation of a trade union as long as the matters in question have not been confirmed by the judicial authorities. The Committee’s Recommendations insist that the Government, especially the police and the judicial authorities should stop violating trade union rights. We, JRU, appreciate that ILO not only requests the Government to take concrete measures to secure trade union rights, but also makes its attitude clear to monitor, with grave concern, future developments including the trial. Therefore we request the Government to work on the Committee’s Recommendations in good faith. We also appreciate that the ILO rejects the Government’s assertion justifying massive search and confiscation, and it requests the Government to return seized items immediately, emphasizing the significance of securing trade union property appropriately. It further points out the search and confiscation by the Japanese police and judicial authorities is a serious matter, in light of internationally recognized basic trade union rights. It is very significant that ILO requests the police to abstain from campaigns that may damage the reputation of the trade union, such as police claims of the alleged infiltration by extremists, Kakumaru sect. The police authorities should reflect deeply and apologize to JRU and its affiliated unions for undue oppression. Moreover, KOKUROU and JR RENGO, who have repeatedly attacked JRU and its affiliated unions in concert with the Government should make their attitude clear on these points of the Recommendations. The Japanese Government should accept the international authority’s conclusion that actions by the police and judicial authorities are undue and in violation of trade union rights. The Japanese authorities should take this chance to drastically change their unjust attitude of attacking the trade union movement, the peace movement and civil society movements. Under widespread neo-liberal globalization, we, JRU, should struggle against the infringement of trade union rights, which has intensified worldwide, and overcome oppression. We should keep on fighting in solidarity, to ensure a court decision that all of the JRU7 members are cleared of the charges against them. |
